{"id":5360,"date":"2016-07-08T17:49:27","date_gmt":"2016-07-08T17:49:27","guid":{"rendered":"https:\/\/losfresnosnews.net\/?p=5360"},"modified":"2016-07-08T17:49:42","modified_gmt":"2016-07-08T17:49:42","slug":"scotus-upholds-use-of-race-in-texas-college-admissions","status":"publish","type":"post","link":"https:\/\/losfresnosnews.net\/?p=5360","title":{"rendered":"SCOTUS Upholds Use of Race in Texas College Admissions"},"content":{"rendered":"<p style=\"text-align: center;\"><strong><em>by Mark Richardson<\/em><\/strong><\/p>\n<p align=\"left\"><strong>AUSTIN, Texas<\/strong> \u2013 The U.S. Supreme Court\u2019s <a href=\"http:\/\/www.supremecourt.gov\/opinions\/15pdf\/14-981_4g15.pdf\" target=\"parent\">ruling<\/a> on Thursday, June 23rd,\u00a0that the University of Texas can consider race as part of its admissions criteria in order to diversify its student body was a bitter defeat for Texas conservatives, who maintain the policy discriminates against white applicants.<\/p>\n<p>But the ruling was an unexpected surprise for minority groups and advocates of affirmative action.<\/p>\n<p>Philip Martin, deputy director of Progress Texas, says after an eight-year journey through the courts, it\u2019s good to have the issue settled.<\/p>\n<p>\u201cWhat the Supreme Court said was that UT\u2019s policies are working, and that they are good,\u201d he states. \u201cNo policy is perfect forever, but right now, the process by which the University of Texas admits students and the affirmative action programs in place are legal and allowable under the law.\u201d<\/p>\n<p>The ruling was 4-to-3 with Justice Elena Kagan recusing herself because she had worked on the issue as solicitor general.<\/p>\n<div id=\"attachment_5347\" style=\"width: 610px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/losfresnosnews.net\/wp-content\/uploads\/2016\/07\/gr-52613-1-1.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-5347\" class=\"size-full wp-image-5347\" src=\"https:\/\/losfresnosnews.net\/wp-content\/uploads\/2016\/07\/gr-52613-1-1.jpg\" alt=\"The U.S. Supreme Court had upheld the use of race as a factor in admissions policies at the University of Texas-Austin. Photo: University of Texas<\/p><\/div>\n<p>In the end, the justices ruled that a person\u2019s race can be one factor among many in helping colleges and universities achieve student body diversity.<\/p>\n<p>Abigail Fisher, a white applicant who maintained that UT had discriminated against her in its admissions policy, filed the suit in 2008.<\/p>\n<p>She said the university violated her constitutional right to equal protection by using race as one of its deciding factors.<\/p>\n<p>Martin says he hopes the ruling encourages other schools to diversify their student bodies.<\/p>\n<p>\u201cWe wish there would\u2019ve been a ninth justice on the court, so there could\u2019ve been a nine-member vote,\u201d he states. \u201cThat said, this decision does set precedent for the country, and we hope that universities \u2013 not just here in Texas, but across the entire United States \u2013 continue to look at using affirmative action in admissions policies. \u201c<\/p>\n<p>President Barack Obama praised the decision, saying it doesn\u2019t guarantee equal outcomes but promotes equal opportunities.<\/p>\n<p>Several states, including Arizona, California, Florida and Michigan, currently forbid the use of race in their university admissions processes.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>by Mark Richardson AUSTIN, Texas \u2013 The U.S. Supreme Court\u2019s ruling on Thursday, June 23rd,\u00a0that the University of Texas can consider race as part of its admissions criteria in order to diversify its student body was a bitter defeat for Texas conservatives, who maintain the policy discriminates against white applicants.
