Photo: Max Pixel<\/p><\/div>\n<p><em><strong>by Eric Galatas<\/strong><\/em><\/p>\n<p align=\"left\"><strong>HOUSTON \u2013<\/strong>\u00a0Texas \u201cDreamers,\u201d young people brought into the U.S. when they were small children, are bracing for the next legal hurdle facing the Deferred Act for Childhood Arrivals program, or DACA.<\/p>\n<p>On Wednesday, a federal court in Houston will hear arguments by Texas and six other states seeking an\u00a0<a href=\"https:\/\/www.texasattorneygeneral.gov\/files\/epress\/File-Stamped_Complaint.pdf?cachebuster:64\" target=\"parent\">injunction<\/a>\u00a0to end the program.<\/p>\n<p>Marielena Hincapie, the executive director of the\u00a0<a href=\"https:\/\/www.nilc.org\/\" target=\"parent\">National Immigration Law Center<\/a>\u00a0says so far federal courts have sided with Dreamers since the Trump administration moved to end DACA last year.<\/p>\n<p>\u201cAfter losing in court after court and failing to get what they want through the proper channels, the Trump administration, Texas, and a dwindling handful of states are attempting an end-run in the courts to shut down DACA applications,\u201d she explains.<\/p>\n<p>Last week, a D.C. federal court ruled that the Trump administration must resume DACA, and called the decision to end the program \u201carbitrary and capricious.\u201d<\/p>\n<p>Texas Attorney General Ken Paxton filed for an injunction in May to end DACA, and argues the program is unconstitutional because the Obama administration\u2019s executive order changed federal law without congressional approval.<\/p>\n<p>Donald Verrilli,\u00a0a former U.S. Solicitor General under President Barack Obama, says since the states involved in Wednesday\u2019s hearing waited six years after DACA\u2019s implementation to file for an injunction, they could have a hard time making the case they\u2019re subject to immediate and irreparable injury.<\/p>\n<p>\u201cIt\u2019s very hard to see that as anything other than a misuse of the judicial process in order to try to achieve policy objectives,\u201d he says.<\/p>\n<p>Greisa Martinez, the Deputy Executive Director of the immigrant youth group,\u00a0<a href=\"https:\/\/unitedwedream.org\/\" target=\"parent\">United We Dream<\/a>, says regardless of the outcome of Wednesday\u2019s hearing, her group and others will continue to work to protect people from being separated from the only communities they have ever known.<\/p>\n<p>\u201cWe will not be used as bargaining chips in Trump\u2019s cruel strategy to detain and deport millions of our families and friends,\u201d she states. \u201cIn the face of uncertainty and danger, immigrant youth and our allies are determined to live unafraid and to continue our fight to defend our families.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>by Eric Galatas HOUSTON \u2013\u00a0Texas \u201cDreamers,\u201d young people brought into the U.S. when they were small children, are bracing for the next legal hurdle facing the Deferred Act for Childhood Arrivals program, or DACA.
